Terms of Service

1. Acceptance of terms

By accessing or using ex1nutrition.com (the Site), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site. These terms are entered into between you and Vynza Pharmaceuticals Pvt. Ltd., which operates the EX1 brand.

2. Nature of the site

ex1nutrition.com is both a brand and content site and, where enabled, a direct retail channel. EX1 products are sold, where available, through authorised online marketplaces such as Amazon India and, when checkout is enabled on this Site, directly through ex1nutrition.com. A purchase you make on a marketplace is governed by that marketplace's own terms of use, shipping policy, and refund policy; EX1 does not process marketplace payments or store marketplace payment data. A purchase you make directly on this Site is governed by these Terms, the Privacy Policy, and the Shipping, Cancellations and Refunds policy, and is processed through our payment partner, Cashfree Payments, under its own terms.

3. Accounts

An EX1 account is optional. You never need an account to complete a purchase on this Site; guest checkout is always available. Creating an account lets you view past orders, save an address, and (where enabled) hold and earn referral credit.

Accounts sign in with a one-time code sent to your email address; EX1 does not use passwords. You must be 18 years or older to create an account, and you confirm this at signup. You are responsible for keeping access to your email address secure, since that is what controls sign-in to your account. You may request deletion of your account at any time from your account page or by writing to care@ex1nutrition.com; see the Privacy Policy for how account deletion works and what is retained afterward.

4. Orders, pricing, and payment

All prices shown at checkout are in Indian Rupees and inclusive of applicable taxes (GST). Shipping charges, where applicable, are shown separately before payment. We recompute every order's price on our server from our own current catalog at the moment you check out; a price shown earlier in a session is not a binding offer until checkout confirms it.

Payment for a direct-store order is collected through Cashfree Payments. We do not store your card, UPI, or netbanking credentials; Cashfree processes and secures payment details under its own security standards. An order is confirmed only once payment is successfully captured and you receive an order confirmation email; if payment is attempted but not captured, no confirmed order is created, though the details you entered are retained as described in our Privacy Policy. No charge should remain outstanding, but in the rare case a deducted amount is not reflected as a confirmed order within a reasonable time, contact care@ex1nutrition.com with your payment reference.

Where cash on delivery is offered on a direct-store order, an advance of Rs 100 is collected through Cashfree Payments when you place the order, and the balance is collected by the courier at delivery. The advance is adjusted against your order total and is not an additional charge. We refund it in full if you cancel before dispatch or if we are unable to dispatch your order; it is not refunded if delivery is refused or cannot be completed after the courier's attempts, or if the order is cancelled after dispatch. We reserve the right to cancel an order and refund any amount charged if a listed price was a genuine pricing or stock error, if fraud or abuse is suspected, or if we are otherwise unable to fulfil it, and will notify you by email if this happens.

5. Delivery

We ship direct-store orders across India through our courier partners. Estimated delivery windows shown at checkout, on your order-status page, and in your confirmation email are our best current estimate, not a guaranteed delivery date. Risk in the goods passes to you on delivery to the address you provided; please check your address carefully before placing an order, since we ship to the address on the order, not a later-corrected one, unless you contact us before dispatch.

6. Cancellation and refunds

Full cancellation and refund terms for direct-store orders, including the window for a no-penalty cancellation before your order ships, are set out in our Shipping, Cancellations and Refunds policy, which forms part of these Terms. Amazon purchases follow Amazon's own return and refund process, not this policy.

7. Coupons and referral credits

Promotional coupon codes and any account credit earned through the referral program (where enabled) are provided at EX1's discretion, have no cash value, cannot be exchanged for cash, and cannot be combined with each other in a single order (one code or one wallet-credit redemption per order). A coupon or referral credit may carry an expiry date, after which it can no longer be applied. We may void or withhold a coupon or referral credit, and reverse any already-applied benefit, if we reasonably believe it was obtained through a fake or duplicate account, a same-device signup pattern, a disposable email address, or any other manipulation of the referral program; where a related order is cancelled, refunded, or returned to us undelivered, any referral credit tied to that order is reversed. We may modify or discontinue the coupon or referral program at any time; changes do not retroactively cancel a credit already earned and vested, but do apply to credits not yet vested.

8. Intellectual property

All content on the Site, including the EX1 brand name, the "Be Exact. Live Exact." tagline, logos, product names, product renders, ingredient descriptions, articles, photography, and site design, is the intellectual property of Vynza Pharmaceuticals Pvt. Ltd. The content is protected by applicable Indian and international copyright, trademark, and design law.

9. Permitted use

You may access and read the content on the Site for personal, non-commercial informational purposes, and use the direct-store checkout for genuine personal purchases. You may not:

• Scrape, crawl, or systematically extract content for any commercial purpose.
• Reproduce, republish, or distribute the content on third-party platforms without written permission.
• Use EX1 brand assets, including the logo and product renders, in a manner that suggests endorsement or affiliation that does not exist.
• Reverse-engineer or extract proprietary formulation information from the published descriptions.
• Create multiple accounts, use false identity details, or otherwise attempt to manipulate the coupon or referral program.

10. User-submitted content

If you submit content directly to EX1 (newsletter signup, email to care@), you grant Vynza Pharmaceuticals Pvt. Ltd. a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for marketing, customer-support, and quality-improvement purposes. You retain ownership of your submitted content; this license is revocable by emailing care@ex1nutrition.com to opt out of future use.

11. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis. EX1 and Vynza Pharmaceuticals Pvt. Ltd. make no warranty, express or implied, regarding the accuracy, completeness, or reliability of any content on the Site, including product descriptions, science articles, and FAQ entries. Content is educational in nature and does not constitute medical advice. See our Disclaimer for further detail.

12. Limitation of liability

To the maximum extent permitted by applicable Indian law, including the Consumer Protection Act, 2019, Vynza Pharmaceuticals Pvt. Ltd. shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Site or your use of EX1 products. Where the Consumer Protection Act, 2019 limits the extent to which liability may be excluded for consumer goods or services, the statutory limit applies and nothing in this clause should be read as overriding those limits. An Amazon-purchase issue, including shipping, damage in transit, or refund processing, is governed by Amazon India's terms of use, not by these Terms; a direct-store order issue is governed by these Terms and the Shipping, Cancellations and Refunds policy. 13. Indemnification

You agree to indemnify and hold harmless Vynza Pharmaceuticals Pvt. Ltd., its directors, employees, and affiliates from any claims, damages, or costs arising out of your breach of these Terms or your misuse of the Site, its content, or the direct-store checkout.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to the paragraph below, the courts at Panchkula, Haryana shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, with appeals lying to the High Court of Punjab and Haryana at Chandigarh.

Nothing in this clause limits your rights as a consumer under the Consumer Protection Act, 2019, including your right to institute a complaint before a District, State or National Consumer Disputes Redressal Commission having jurisdiction where you reside or work for gain.

15. Modifications

Vynza Pharmaceuticals Pvt. Ltd. reserves the right to modify these Terms at any time. Material changes will be notified to newsletter subscribers ahead of taking effect. The Last reviewed date at the top of this page reflects the current version.

16. Notices

Vynza Pharmaceuticals Pvt. Ltd. may give notices under these Terms by posting an update to this page, sending an email to newsletter subscribers or account holders, or any other reasonable method. Notices from you to Vynza Pharmaceuticals Pvt. Ltd. should be sent to care@ex1nutrition.com. A notice is deemed received on the date the email is delivered.

17. Force majeure

Vynza Pharmaceuticals Pvt. Ltd. is not liable for any failure or delay in performance under these Terms that is caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, internet or hosting outages, acts of war or terrorism, and labour disruptions affecting third-party suppliers, logistics partners, payment processors, or platforms (including Amazon India) on which the brand depends.

18. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be read down to the minimum extent necessary to make it enforceable, while preserving the original intent.

19. Waiver

No failure or delay by Vynza Pharmaceuticals Pvt. Ltd. in exercising any right under these Terms shall operate as a waiver of that right. No waiver of any term shall constitute a waiver of any subsequent breach of the same or any other term.

20. Assignment

Vynza Pharmaceuticals Pvt. Ltd. may assign or transfer its rights and obligations under these Terms to any successor, affiliate, or acquirer of the EX1 brand without your consent. You may not assign your rights or obligations under these Terms without the prior written consent of Vynza Pharmaceuticals Pvt. Ltd.

21. Survival

Sections 8 (Intellectual property), 11 (Disclaimer of warranties), 12 (Limitation of liability), 13 (Indemnification), 14 (Governing law and jurisdiction), and any other clause that by its nature should survive termination, shall survive any termination or expiry of these Terms.

22. Entire agreement

These Terms, together with the Privacy Policy, the Shipping, Cancellations and Refunds policy, and the Disclaimer published on this Site, constitute the entire agreement between you and Vynza Pharmaceuticals Pvt. Ltd. with respect to use of the Site, and supersede all prior communications and proposals, whether electronic, oral, or written, on the same subject matter.

23. Headings

Section headings in these Terms are provided for convenience and shall not affect interpretation. References to "include" or "including" shall be read as if followed by "without limitation".
